for use of the FeelingSafe (Tryghedsappen) mobile application

1. Service Provider

The FeelingSafe App is provided by:

These Terms and Conditions govern the use of the Tryghedsappen mobile application, associated services, and the website:
www.tryghedsappen.dk

2. Description of the Service

Tryghedsappen is a mobile application designed to allow users to quickly request assistance from a personal network.

The application includes an alarm button which a user may activate in situations where they need urgent assistance. When the alarm is activated, the application sends a notification to the user’s registered network contacts.

The alarm notification may include:
• the user’s name
• the time of the alarm
• the user’s geographic location
• other information related to the alarm event

Network contacts consist of individuals selected by the user, such as family members, friends, neighbours or other trusted persons.

3. Nature and Limitations of the Service

Tryghedsappen is a digital communication tool designed to facilitate contact between a user and their selected personal network.

The service is not:
• a public emergency service
• a rescue service
• a medical service
• a healthcare solution

The application does not replace public emergency services such as:
• national emergency numbers (e.g. 112)
• ambulance services
• police services
• fire services

In life‑threatening or medical emergencies, users must always contact the appropriate public emergency services immediately.

4. Emergency Services Disclaimer

The service is provided to assist communication between private individuals and must not be considered an emergency response system.

Activation of an alarm through the application does not automatically notify emergency authorities.

5. User Responsibilities

The user is responsible for the correct setup and use of the application.

This includes, but is not limited to:
• registering appropriate network contacts
• ensuring that those contacts have agreed to receive alarms
• ensuring the mobile device is adequately charged
• maintaining an active internet connection or mobile network
• enabling location services where location sharing is desired

6. Network Contacts

Network contacts are selected and managed solely by the user.

Network contacts are private individuals and are not professional emergency responders.

The service provider has no control over whether network contacts respond to alerts and cannot be held responsible for a lack of response.

7. Technology Dependencies

The functionality of the application depends on technological systems that are outside the control of the service provider.

This includes, but is not limited to:
• the user’s mobile device hardware
• the mobile device operating system
• Apple iOS and Google Android platforms
• mobile networks and internet connectivity
• third‑party services such as push notification systems

Failures or interruptions in these systems may affect the functionality of the application.

8. ThirdParty Services Disclaimer

The application may rely on or integrate with third‑party platforms or services including Apple App Store, Google Play, push notification providers, and network services.

The provider is not responsible for outages, failures, policy changes, or technical limitations originating from such third‑party services.

9. Acceptable Use

Users agree to use the application only for lawful purposes.

Users must not misuse the service, including but not limited to:
• sending false alarms intentionally
• harassing or misleading network contacts
• using the application for unlawful activity
• attempting to interfere with the operation or security of the service.

10. Intellectual Property

All intellectual property rights in the application, including software, design, trademarks, and content, belong to Tryghedsappen ApS or its licensors.

Users are granted a limited, non‑exclusive, non‑transferable licence to use the application for personal use in accordance with these Terms.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the provider shall not be liable for:

• direct or indirect damages
• consequential losses
• personal injury
• economic loss

arising from the use or inability to use the application.

This includes circumstances involving:
• technical errors
• software faults
• network failures
• battery depletion
• failures of third‑party services
• lack of response from network contacts.

12. Platform Compliance

The application is designed to comply with applicable platform requirements including:

• Apple App Store Review Guidelines
• Google Play Developer Policies

Users must use the application in accordance with the terms and policies of these platforms.

13. EU Digital Services Act Compliance

The provider aims to comply with applicable provisions of the EU Digital Services Act (DSA).
Misuse of the service or illegal activities may be reported to the provider using the contact details provided in this document.

14. Age Requirements

The minimum age for use of the service is 13 years.

Where the service is used by elderly or vulnerable individuals, it is recommended that the application be configured with assistance from family members or caregivers.

15. Data Protection

Processing of personal data is described in a separate document:

Privacy Policy for the FeelingSafe app.

16. Termination of Service

The provider reserves the right to suspend or terminate access to the service where necessary, including in cases of misuse, violation of these Terms, or technical or operational requirements.

Users may discontinue use of the service at any time by removing the application from their device.

17. Changes to the Terms

The provider may update or modify these Terms from time to time.

The latest version will always be available via:
• the mobile application
• the website www.feelingsafe.uk
